Sinden in Significant Court Win

Theatre producer Marc Sinden, of the One Night Booking Company Ltd, has won a court case against Kevin Marsh, trading as Azur Productions, which has great significance for the worlds of theatre and entertainment. The case involves a substantive breach of contract and procuring a breach of contract, concerning The One Night Booking Company’s show featuring the entertainer Gyles Brandreth.

The contract in question was between the One Night Booking Company and Azur Productions which is based in Monaco, which has a unique standing legally within Europe and the EC. Sinden's lawyers successfully argued that a Court can serve papers and judgements 'outside of the Courts jurisdiction' in the matter of breach of contract, when the contract has been issued within the jurisdiction.

This enabled Barnet Civil Court to award judgment to Sinden on 28th June.

"It really was so stupid that this matter even had to get as far as the Courts," Sinden said. "We offered Kevin Marsh every opportunity to compromise. However if you try to walk away from a signed contract, deny its existence and then try to book the same artist for the same date through someone else, you have to suffer the consequences. The person I feel most sorry for is Gyles Brandreth who through absolutely no fault of his own has lost a potentially lucrative booking due to a hissy-fit from Mr Marsh."

Marsh offered no defence and has not to date offered any settlement terms. Court Bailiffs have now been instructed to recover the debt which will be entered as such with the Register of Judgments, Orders and Fines for six years and also as a CCJ with the credit reference agencies Equifax, Experian and Call Credit.
